In these Terms & Conditions, “Cannoleria Piccola®”, “we”, “us” or “our” refers to Archizen Pty Limited, trading as Cannoleria Piccola®, of Shop 3/5 Belgrave Street, Kogarah NSW 2217.
“You” refers to the user of this website or the customer placing an order with us.

This website is provided for your general information and personal use. We may update, change or remove content from this website at any time without notice.

While we take reasonable care to ensure the information on this website is accurate and up to date, we do not guarantee that all content, product descriptions, pricing, availability or other material will always be complete, current or error-free.

Your use of any information on this website is at your own discretion, and it is your responsibility to ensure that any products, services or information available through this website meet your needs.

Cannoleria Piccola® specialises in fresh cannoli, desserts and selected related products. Because many of our products are handmade and prepared fresh, product appearance, decoration and availability may vary from time to time.

We reserve the right to withdraw, substitute or change products, flavours, pricing, trading hours or availability without notice.

All orders placed through our website, by phone, by message or in person are subject to acceptance and availability.

We reserve the right to refuse, decline or cancel any order where:

• a product is unavailable
   
• there is an error in price or product information
   
• we are unable to fulfil the order
   
• we reasonably suspect fraudulent, unlawful or unauthorised activity
   

If we cancel an order after payment has been made, we will provide an appropriate remedy in line with your rights under Australian Consumer Law.

We reserve the right to substitute flavours or fillings where reasonably necessary due to ingredient availability or quality-control issues, including substituting ricotta-based fillings with custard where appropriate, using the closest available option of similar quality and value.

All prices on this website are in Australian Dollars (AUD) unless otherwise stated.

Prices are subject to change without notice. Payment must be made in full at the time of ordering unless otherwise agreed by us in writing.

We reserve the right to correct pricing errors, inaccuracies or omissions at any time, including after an order has been submitted.

Our food products are freshly prepared and are perishable. For best quality, products should be consumed promptly and stored appropriately after collection or delivery.

Because preparation for food orders may begin shortly after an order is placed:

• changes or cancellations may not be possible once preparation has commenced
   
• we are not responsible for deterioration in quality caused by delayed collection, transport, storage or handling after pickup or delivery
   
• customers are responsible for ensuring orders are collected at the agreed time
   

Nothing in these Terms & Conditions excludes any rights you may have under Australian Consumer Law. Consumer guarantees apply automatically and cannot be excluded by contract. 

Our products are prepared in a kitchen and retail environment that handles common allergens, including but not limited to gluten, dairy, egg, soy, peanuts and other nuts.

While we take care in preparing our products, we cannot guarantee that any product is free from allergens, traces or cross-contact.

If you or anyone consuming our products has an allergy, intolerance or dietary concern, please contact us before ordering. It is your responsibility to determine whether our products are suitable for your needs.

Where pickup is offered, customers are responsible for collecting their order from our nominated pickup location during the agreed collection time or within trading hours.

Risk in the product passes to you once the order has been collected by you, your representative, or a third-party courier or delivery driver.

If delivery is provided through a third-party platform or provider, that order may also be subject to the terms and conditions of that third party. We are not responsible for delays, missed deliveries or issues caused by third-party delivery services, except where required by law.

We want our customers to be happy with their order. If there is a problem with your order, please contact us as soon as possible with your order details and, where relevant, photographs of the issue.

We do not offer refunds for change of mind.

However, nothing in these Terms & Conditions excludes, limits or modifies your rights under the Australian Consumer Law. Where a product or service fails to meet a consumer guarantee, you may be entitled to a remedy such as a refund, replacement, repair, resupply or other appropriate remedy depending on the circumstances. 

This website contains material owned by or licensed to us, including our branding, text, images, graphics, layout and design. This material must not be copied, reproduced, republished, distributed or used for commercial purposes without our prior written consent.

Cannoleria Piccola® and associated branding are our intellectual property unless otherwise stated.

From time to time, this website may include links to other websites for your convenience. These links do not mean that we endorse those websites. We are not responsible for the content, availability or practices of any linked third-party website.

Unauthorised use of this website may give rise to a claim for damages and/or may be a criminal offence.

You must not misuse this website, attempt to interfere with its operation, or use it for unlawful, fraudulent or harmful purposes.

If you subscribe to our email list or otherwise consent to receive marketing from us, you agree that we may send you updates, promotions, news and other information about Cannoleria Piccola®.

You may unsubscribe from marketing emails at any time using the unsubscribe link in the email or by contacting us directly. Australian spam rules require commercial electronic messages to include a working unsubscribe option that is easy to use. 

To the maximum extent permitted by law, we exclude liability for any indirect, incidental or consequential loss arising from your use of this website or from your purchase of our products.

Nothing in these Terms & Conditions excludes or limits any rights, guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Standard form contracts cannot rely on unfair terms, so overly broad exclusions and one-sided rights should be avoided. 

We may update these Terms & Conditions from time to time. Any changes will take effect once the updated version is published on this website.

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes relating to the use of this website or our products will be subject to the non-exclusive jurisdiction of the courts of New South Wales.

IMPORTANT Allergens - Most of our food products contain soy, gluten, dairy, egg and nuts or traces of nuts. They are made in an environment that uses a significant amount of nuts. Unfortunately, we cannot guarantee that our products are strictly free from allergens. While we try to do our very best, cross contamination is a possibility during production. If you have food allergies of any kind, you agree not to purchase any of our products.
